CONTACT THE JUDICIARY COMMITTEE IN SUPPORT OF SB 89

SB 06-89, the clean-up bill for SB 100, will be heard by the Senate Judiciary Committee on Monday, February 6, at 1:30 pm. As with most legislation, SB 89 is a result of compromises and a balancing of interests involved. We believe that although SB 89 is not perfect (but what is?), it does a reasonable and fair job of addressing many of SB 100's problem areas. (SB 89's provisions are discussed in this post.)

Please contact the members of the Judiciary Committee by Friday, February 3, to ask them to support SB 89 in its current form as well as any amendments suggested by Senator Bob Hagedorn. Be sure to let them know if you are a constituent. The contact information is as follows:

Our HOA of which I am president has embraced SB 100 and we have made every attempt to be in complete compliance. While we do not agree with everything in total and we support some changes and language "clean up" we do see several benefits.
Regarding HOA legislation, it is my request that you would pass legislation to bring ALL Colorado HOAs under CIOWA rules. Those that have been in existence prior to July 1992 need to be under the same regulations. I believe that this is in the interest of all property owners and consumers. I own property that is not under CIOWA and am president of an HOA that is under CIOWA and it is very hard to understand (and very confusing) why both HOAs do not have to follow the same rules. Please let me know if there is anyway this can be changed? I appreciate your assistance with this.

Please give serious consideration in favor of Senate Bill 89. As a condo homeowner, an active board member and some 12 plus years in the management of HOA SB 89 is needed to preserve the working of an association and those of us who will give their time to serve on the board of directors.

After being all three sides of the condo life, 12 years in the property management business for HOA's, condo homeowner and serving as a board member I can attest that the boards of directors most generally take the abuse for trying to protect the association's members investment and for sure the property managers take the brunt of complaints, justified, and those that are not.

It is, the homeowners of the HOA who have fail the system, by not participating in the system. They do not show up for the board meetings to become informed of the problems and what it takes to keep the association afloat. They are the same homeowners, who yell the loudest when tough decisions have to be made by the board. Where were these same homeowners when the board members needed volunteers for the committees to help solve a problem?

It is now time for you to make some tough decisions to preserve the system and for those who have to serve it by passing SB 89 a reasonable compromise.
